Actually, when there is no evidence of a crime, it would be prosecutorial misconduct to indict. That’s like saying the cops had a “choice” to shoot you for jaywalking. In a highly theoretical world, I guess you could say there’s a choice, but in reality, it’s not really a choice at all.
