In a followup to the tragic car wreck story, the officials involved in letting this illegal alien murderer get back behind the wheel of a car are all scrambling to justify why they dropped the ball.

A Harris County prosecutor, criticized for negotiating in 2005 a reduced drunken driving penalty for a man now accused of intoxicated manslaughter in the death of two women, said Wednesday she believed a jury would have been equally lenient.

If convicted of a felony in the 2005 case, Gomez-Gutierrez would have faced two to 10 years in prison.

But more importantly, he would’ve likely been deported.

Yet [assistant Harris County district attorney Colleen] Barnett believes the terms she negotiated in the 2005 plea agreement were justified based on the fact that Gomez-Gutierrez had no violent criminal past and none of three DWIs involved an accident or injury.

And now we see just how violent and criminal a DWI can be. Unfortunately, for the victims, it’s a little too late.

It also appears the illegals understand our immigration laws and prosecution better than the folks hired to enforce such laws. When Barnett offered Gomez-Gutierrez a plea deal with two options of either pleading guilty to a felony and receive five years probation, 30 days confinement, $500 fine, 160 hours of community service and substance abuse treatment or pleading guilty to a misdemeanor and spend a year in county jail, he took the misdemeanor because, as Barnett says:

He might not have chosen the felony probation out of fear of deportation, Barnett said, adding sometimes defendants think it’s “easier to sit out the jail time.”

ICE also showed no interest in dealing harshly with this repeat offender.

Harris County Sheriff’s Sgt. Dana Wolfe said federal immigration authorities are notified whenever an illegal immigrant is booked into the jail, like Gomez-Gutierrez.

“They then had an opportunity to place them on hold (for deportation). But it was totally up to them,” she said.

Deason, the immigration spokeswoman, said she could not say if the agency was notified until she gets the file.

“We were trying to focus on worst of the worst, felonies such as aggravated sexual assaults and murders back in 2005,” she said.

Well, now you got a murderer. I guess it’s okay to deal with him now.

Tragic.

On a side note: Hat’s off to Houston Chronicle reporter Cindy Horswell for not being afraid to call the illegal an illegal.

Gomez-Gutierrez, a 25-year-old illegal immigrant from Mexico, is now facing his fourth drunken driving charge.

More corrupt dealings from the Democrats:

SEN. Dianne Feinstein has resigned from the Military Construction Appropriations subcommittee. As previously and extensively reviewed in these pages, Feinstein was chairperson and ranking member of MILCON for six years, during which time she had a conflict of interest due to her husband Richard C. Blum’s ownership of two major defense contractors, who were awarded billions of dollars for military construction projects approved by Feinstein.

But, hey, at least she took the moral high road and resigned in the face of her corruption…

…or was there another reason for her stepping down?

Perhaps she resigned from MILCON because she could not take the heat generated by Metro’s expose of her ethics (which was partially funded by the Investigative Fund of the Nation Institute). Or was her work on the subcommittee finished because Blum divested ownership of his military construction and advanced weapons manufacturing firms in late 2005?

I guess it’s just a matter of nuance.

This is corruption of the worst kind. Think the Democrats will investigate? Think the MSM will cover this story?

Don’t be silly.

Bryan points out information in the Metroactive article that may tie Feinstein’s scandal to the VA story.

Feinstein abandoned MILCON as her ethical problems were surfacing in the media, and as it was becoming clear that her subcommittee left grievously wounded veterans to rot while her family was profiting from the occupations of Iraq and Afghanistan. It turns out that Blum also holds large investments in companies that were selling medical equipment and supplies and real estate leases—often without the benefit of competitive bidding—to the Department of Veterans Affairs, even as the system of medical care for veterans collapsed on his wife’s watch.

As of December 2006, according to SEC filings and www.fedspending.org, three corporations in which Blum’s financial entities own a total of $1 billion in stock won considerable favor from the budgets of the Department of Defense and the Department of Veterans Affairs:

# Boston Scientific Corporation: $17.8 million for medical equipment and supplies; 85 percent of contracts awarded without benefit of competition.

# Kinetic Concepts Inc.: $12 million, medical equipment and supplies; 28 percent noncompetitively awarded.

# CB Richard Ellis: The Blum-controlled international real estate firm holds congressionally funded contracts to lease office space to the Department of Veterans Affairs. It also is involved in redeveloping military bases turned over to the private sector.

Michelle sees that the San Fransisco Chronicle’s priorities are focused on baseball, not some corrupt Democrat in their district.

Rusty contrasts the coverage of this corruption to the coverage given to the Duke Cunningham story. It’s amazing how changing an (R) to a (D) will do for media coverage and calls for Congressional investigations.

Michelle wonders whether Feinstein will also resign from the Senate Rules Committee also. You know, the committee responsible for issues like ETHICS REFORM.

Steve Forbes Joins Rudy’s Campaign

This is a nice endorsement for Rudy.

Fiscal conservative Steve Forbes on Wednesday endorsed former New York mayor Rudy Giuliani’s bid to become the Republican nominee for president in the 2008 race for the White House.

Forbes, chief executive of Forbes magazine who unsuccessfully sought the Republican nomination in 1996 and 2000, is considered a leader of the party’s pro-business and tax-cutting wings.

“He is the man who can lead America in a world that is uncertain, fight the forces of evil and at the same time increase economic opportunity here at home,” Forbes told a press conference.

According to an email I got from the Exploratory Committee Chairman, Forbes will serve as a National Campaign Co-Chair and Senior Policy Advisor to the campaign:

The Rudy Giuliani Presidential Exploratory Committee today announced that Steve Forbes, President and Chief Executive Officer of Forbes and Editor-in-Chief of Forbes magazine, has endorsed Rudy Giuliani for President of the United States. Mr. Forbes will serve as a National Campaign Co-Chair and Senior Policy Advisor.

I saw Steve Forbes at an event here in Houston a couple of weeks ago:


I really like his stance on the tax code in this country. He advocates getting rid of it. That’s a plan I can fully support.

I witnessed this horrific wreck on Sunday that killed two three people.

Police said Ignacio Gomez-Gutierrez, 25, was speeding along the 22600 block of the Eastex Freeway about 3:40 p.m. Sunday when his pickup slammed into the back of a car.

Vanessa Ortiz, 18, and Maria Ortiz, 49, were in the 1998 Buick when it was struck from behind. They were both killed on impact, police said.

Vanessa Ortiz was also 5 months pregnant.

This is video of the scene moments after. It was a terrible wreck and I was in shock in seeing the car crumpled like a soda can. I knew the results were not going to be good.

The man driving the truck that crashed into the victims hopped out and tried to run away, only to be hit by a car himself. He survived, was arrested and is now facing two counts of intoxication manslaughter. (I’d argue it should be three)

When we saw him jump out and start to run, the group of witnesses surrounding me started wondering aloud about why he would run. Some thought he may have been drunk. Others suggested he could’ve been an illegal.

Turns out he was BOTH.

From the Houston Chronicle:

According to the investigating Houston police officer, Javier Calvillo, Gomez-Gutierrez’s blood alcohol was about three times the legal limit.

And this wasn’t his first time. He had three prior DWI convictions. THREE!

For the first misdemeanor conviction in 2002, he received 60 days confinement and for the second misdemeanor conviction in 2004 he was sentenced to only 10 days.

The third conviction should have been a felony, but it was reduced to a misdemeanor for which he was sentenced to a year in the county jail.

And as if that wasn’t enough bad news, it turns out he was also an illegal. According to an email I received from Cindy Horswell of the Chronicle, “Gomez-Gutierrrez was an illegal immigrant who entered this country in 2001 and was never deported after any of the three prior convictions.”

“We are so angry,” said Sylvia Flores, 28, whose mother and younger sister died in the accident. “If everyone had done what they were supposed to do, they would still be alive. I don’t want (Gomez-Gutierrez) to slip through the cracks again. He’s just been given a slap on the wrist. No wonder he did it again.”

Is anyone in immigration and law enforcement awake anymore? Consider the deaths of these three innocent people yet another tragic wake up call.

Here’s an update to the story, including reactions from the prosecutor who let Gomez-Gutierrez off the hook and ICE officials who may have missed a chance to deport him… multiple times.

The Senate Democrats (and a couple of antiwar Republicans) voted today to “tie the hands of the Commander-in-Chief by imposing an arbitrary timetable for the withdrawal of U.S. forces from Iraq, thereby undermining the position of American Armed Forces and jeopardizing the successful conclusion of Operation Iraqi Freedom.”

This is what could be heard in chambers after the vote:

They’ll probably follow today’s vote up with another bill to redesign Old Glory… by removing the red and blue.

So Democrats support an arbitrary timetable for withdrawal of our troops? Interesting, considering this is what some of these same Democrats had to say about such arbitrary timetables not so long ago (hat tip: RedState and GatewayPundit):

Senator Jim Webb in September, 2006:

Anyone who tells you we can set a timetable for withdrawal doesn’t understand war. And anyone who says that nothing can be done to speed a secure peace doesn’t understand America.”

Webb voted today to support the troop withdrawal timetable in the bill.

Senator Ben Nelson on March 8, 2007:

Nelson said while he doesn’t back President Bush’s troop surge or having “U.S. troops in the cross hairs of a civil war,” he also doesn’t believe Congress should put a timetable on troop withdrawal.

Nelson voted today to support the troop withdrawal timetable in the bill.

Senator Evan Bayh on March 12, 2007:

“I, for example, am not in support of circling a date on a calendar and saying, ‘no matter what, we’re out on that date.’ ”

Senator Harry Reid in 2005:

“As far as setting a timeline … That’s not a wise decision, because it only empowers those who don’t want us there.”

Yet another attempt to try and prepare the country for a Hillary presidency, there’s a new push in Congress to revive the Equal Rights Amendment… because women are treated so poorly in this country.

The Amendment, which would attempt to finally grant women some equality, will be introduced by female Senator Barbara Boxer and Congresswomen Carolyn Maloney and Lynn Woolsey.

This groundbreaking Amendment, that would finally grant women the ability to be successful in their careers, will likely be highlighted on 60 Minutes with Anchorwoman Katie Couric… or possibly on the Oprah Winfrey show. Maybe J.K. Rowling will finally be able to earn more than $75 million for writing a story about it, or Celine Dion could sing a song about it and finally break that $40 million dollar wall. Perhaps Jodie Foster could endorse it so that one day she can make more than a measley $27 million per film.

Or maybe they can get some corporate sponsorship from some Fortune 1000 CEOs like Claire Babrowski of RadioShack, Brenda C. Barnes of Sara Lee, Dorrit J. Bern of Charming Shoppes, Mary E. Burton of Zale, Patricia Gallup of PC Connection, Susan M. Ivey of Reynolds American, Andrea Jung of Avon Products, Kay Krill of AnnTaylor Stores, Linda A. Lang of Jack in the Box, Kathleen A. Ligocki of Tower Automotive, Anne Mulcahy of Xerox, Janet L. Robinson of New York Times, Paula G. Rosput Reynolds of Safeco, Patricia F. Russo of Lucent Technologies, Mary F. Sammons of Rite Aid, Marion O. Sandler of Golden West Financial, Stephanie A. Streeter of Banta, Margaret C. Whitman of eBay, Mary Agnes Wilderotter of Citizens Communications, or Dona Davis Young of Phoenix.

Thank goodness women have finally achieved positions of power, so that they can finally introduce a bill like this to help women achieve positions of power. Because without such a bill, promoted by women in positions of power, it’s likely that women would never be able to achieve positions of power.

Following on the heals of the House, it appears the Senate thinks adding pork to legislation will help fight muslim terrorists.

Here is what our United States Senate deems “emergency needs” for inclusion in a bill designed to appropriate funds for the war against terrorists:

$100,000,000 for the 2008 political party conventions.

$95,000,000 for dairy producers.

$24,000,000 for sugar beets growers.

$20,000,000 for, in part, insect infestation control in Nevada, thanks to Majority Leader Harry Reid.

$13,000,000 for “ewe replacement and retention”.

$3,500,000 for the Capitol’s guided–tour program.

There’s also funds for a tree assistance program, including, specifically, Christmas trees.

Senator Craig Thomas (R-WY) offered an Amendmentto prevent the adding of extraneous earmarks to an emergency war supplemental” and it was voted down faster than a hairlip on American Idol. 49 of the 59 voting against the Amendment were Democrats (including Lieberman and Sanders).
